Welcome to Yard Sale Finder. These Terms of Service (the "Terms") govern your access to and use of the Yard Sale Finder mobile application, website at yardsalefinder.app, and related services (together, the "Service"). The Service is operated by the owner of Yard Sale Finder ("Yard Sale Finder," "we," "us," or "our").

By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Geographic scope (United States only)

The Service is intended solely for users located within the United States, and yard sale listings are limited to locations within the United States. We make no representation that the Service is appropriate or available for use outside the United States. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, and features may be unavailable or may not function as intended.

2. Eligibility & age

You must be at least 13 years old to use the Service, and at least 18 years old (or the age of majority in your state) to post a sale, buy or sell items in person, or otherwise transact. By using the Service you represent that you meet these requirements, reside in the United States, and are able to form a binding contract with us.

3. Your account

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and be responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised. You may delete your account at any time from within the app.

4. The Service & listings

Yard Sale Finder is a platform that lets users discover, map, post, and search for yard sales and similar community sale events. Listings may be posted by the person hosting a sale (a "host") or by another user who spotted a sale (a "scout").

Yard sale listings are user-generated. We do not host the sales, we are not a party to any transaction between users, and we do not verify the accuracy, existence, timing, pricing, condition, legality, or safety of any sale or item. Listings may be inaccurate, outdated, moved, or cancelled without notice. You use listings at your own risk.

5. User content

"User content" means anything you submit to the Service, including sale details, photos, descriptions, and messages. You retain ownership of your user content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content for the purpose of operating, providing, and promoting the Service.

You represent that you own or have the necessary rights to the content you submit, that it is accurate, and that it does not violate these Terms or any law or third-party right. You are solely responsible for your user content.

6. Acceptable use

You agree not to:

• Post false, misleading, fraudulent, or fake sale listings;
• Post content that is unlawful, infringing, defamatory, harassing, hateful, obscene, or that invades another person's privacy;
• List items whose sale is illegal or restricted (e.g. firearms, weapons, drugs, alcohol, tobacco, hazardous materials, stolen goods, live animals, recalled products, or counterfeit goods);
• Harass, threaten, stalk, impersonate, or harm another person;
• Post another person's address or personal information without permission, or use the Service to locate or approach someone against their wishes;
• Attempt to access accounts or data that are not yours, or interfere with, disrupt, scrape, or reverse engineer the Service;
• Use the Service for spam, advertising, or any commercial purpose we have not authorized;
• Violate any applicable law or the rights of others.

We may remove content or restrict accounts that we believe violate these Terms.

7. Reporting & moderation

The Service provides tools to report content and to block other users. We may — but are not obligated to — review, moderate, remove, or restrict any content or account at our discretion. We aim to review valid reports of objectionable content promptly. Blocking a user hides their content from you and prevents them from interacting with you within the Service.

8. In-person safety

Yard sales involve meeting strangers and visiting physical locations. You are solely responsible for your own safety and for exercising good judgment. Meet in safe conditions, be cautious about sharing personal information, and comply with all local laws. Yard Sale Finder is not responsible for any interaction, transaction, injury, loss, or damage arising from your use of the Service or attendance at any sale.

9. Intellectual property

The Service, including its software, design, logo, and branding, is owned by Yard Sale Finder and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

10. Third-party services

The Service uses third-party providers (for example, mapping, hosting, and notification services) and may link to third-party content. We are not responsible for third-party services, and your use of them may be governed by their own terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including content licenses you have granted, disclaimers, limitations of liability, and indemnification) will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING OR INFORMATION IS ACCURATE OR RELIABLE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YARD SALE FINDER AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY LISTING, OR ANY INTERACTION OR TRANSACTION WITH ANOTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless Yard Sale Finder and its owner from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your user content, your violation of these Terms, or your violation of any law or the rights of another.

15. Governing law

These Terms are governed by the laws of the United States and the State in which the owner of Yard Sale Finder resides, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in that State for any dispute not subject to other resolution.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the app and ask you to re-accept. Your continued use of the Service after changes take effect means you accept the revised Terms.
